Protection and processing of personal data

What is personal data?

Personal data means any information relating to a designated or identifiable data subject. A data subject is considered determined or identifiable if the data subject can be directly or indirectly identified mainly on the basis of a number, code or one or more elements specific to its physical, physiological, psychological, economic, cultural or social identity.

So personal data includes, in particular, the name, surname, address of a natural person, e-mail, IP address, and such data can be information about the use of services or activities/preferences of a natural person. The protection of personal data is governed by Act no. 18/2018 Coll. on the protection of personal data and on the amendment of certain acts, as amended ("Personal Data Protection Law").

What is personal data processing?

The processing of personal data means any operation or set of operations that the administrator or processor systematically performs with personal data, either automatically or by other means, in particular collection, storage on information carriers, making available, modification or change, search, use, transfer, dissemination, disclosure, storage, exchange, sorting or combining, blocking and disposal.

Who is the administrator or personal data processor?

We are the company WearGames s.r.o., with registered office at Záhradná 5826/19, 902 01 Pezinok, which is registered in the Commercial Register of the District Court Bratislava I, section Sro, insert no. 159575/B, Company ID: 54454875, Tax ID: 2121691341, VAT NUMBER: SK2121691341, tel. +421 903 106 367, e-mail: info@wear-games.com (hereinafter referred to as the "administrator"), which operates the e-shop www.wear-games.com.

We process your personal data as an administrator, i.e. we determine how personal data will be processed and for what purpose, for how long, and we select other processors who will help us with processing.

Scope of personal data and processing purposes

We process personal data that you entrust to us for the following reasons (to fulfill these purposes):

  • provision of services, fulfillment of the contract: We absolutely need your personal data in the scope of: name, surname, address, phone number and e-mail to fulfill the contract.
  • bookkeeping: If you are a customer, we need your personal data (invoicing data) in order to comply with the legal obligation to issue and register tax documents.
  • marketing - sending newsletters: We use your personal data (e-mail and name) for the purpose of direct marketing - sending business announcements. If you are our customer, we do so out of legitimate interest because we reasonably assume that you are interested in our news, and we do so for two years from the last order. If you are not our customer, we send you newsletters only based on your consent, for a period of two years from the granting of consent. In both cases, you can withdraw this consent by using the unsubscribe link in each received email message.

We retain your personal data for the duration of the statute of limitations, unless the law provides for a longer period for their retention or we have stated otherwise in specific cases.

Cookies

When browsing our website, we record your IP address, how long you stay on the page, and from which page you come. We use cookies to measure website traffic and customize the display of websites as our legitimate interest as an administrator, because we believe that we can thereby offer you even better services.

The cookie file will therefore enable the website to recognize whether you have visited in the past, and which section you were interested in. Thanks to cookies, you can also save your user settings, etc.

1. Consent to cookies

By visiting our pages, you automatically express your consent to the use of this technology. However, if you would like to delete or limit the use of cookies for any reason, you can do so at any time in your web browser (point 2).

2. Managing cookies

You can freely delete cookies or set your browser in advance so that it either refuses to accept cookies or warns you when the server tries to send you a cookie.

But then websites that depend on the support of cookies may not work as intended, or parts of pages will be unavailable to you.

3. What types of cookies do we use?

We use two types of cookies on our website:

a) Session cookies that are automatically deleted as soon as you leave our site. They help the correct display of pages during the visit.

b) Permanent cookie files that are temporarily stored and may contain the anonymous identifier of your browser. These are used primarily for measurement and advertising, but also, for example, for setting the language and saved settings during the visit to the site for a potential future visit.

But even these cookies do not in themselves identify you as an individual, they only identify the access to the pages and the behaviour of users accessing from a certain device (computer, tablet, smart phone). All data is anonymous, especially for the purpose of site usage statistics.

The measurement cookie recognizes repeated visits to our website from the same browser on the same device, and tracks the activities of visitors when viewing the pages.

Advertising cookies enable the display of targeted advertising on websites and other websites on the Internet that are connected to this advertising system. Targeted advertising is displayed based on the behaviour of anonymous users or groups of users on websites thanks to the identification of their browser, as described above.

Other types of cookies may still be used, for example, for the proper functioning of our services (for example, e-shop) or for testing parts of the website and its functionality. All this helps us increase service quality and customer satisfaction.

Security and protection of personal data

We will handle your personal data responsibly and in accordance with the applicable legislation. We use automated and non-automated means to process personal data. All data is stored on secure servers exclusively in the European Union. We protect personal data to the maximum extent possible using modern technologies that correspond to the level of technical development.

We have adopted and maintain all possible (currently known) technical and organizational measures that prevent misuse, damage or destruction of your personal data.

Provision of personal data to third parties

Our employees and associates have access to your personal data. In order to ensure specific processing operations that we cannot ensure ourselves, we use the services and applications of processors who know how to protect data and specialize in the given data processing.

In the future we may use other applications or processors to facilitate and improve processing. In such case, we pledge that when choosing a processor we will impose the minimum requirements required by law for the security and quality of processing.

Provision of personal data outside the EU

All processing of personal data will be carried out exclusively in the EU.

Your rights related to the processing and protection of personal data

You have rights in connection with the protection of personal data. If you would like to exercise any of these rights, please contact us at: ochrana-udajov@wear-games.com.

  • You have the right to information that is already provided by this information page with the personal data processing policy.
  • Right of access means you can challenge us at any time, and we will provide you with proof within 14 days of what personal data we process and why.  If something changes or if you consider any of your personal data to be out of date or incomplete, you have the right to supplement and change your personal data.
  • You can use the right to restrict processing if you believe that we are processing inaccurate data, you think that we are processing illegally, but you do not want to delete all data, or if you have objected to the processing. You can limit the scope of personal data or processing purposes. (For example, by unsubscribing from the newsletter, you limit the purpose of processing for sending business notifications.)
  • Right to portability - If you would like to take your personal data and transfer it to someone else, we will proceed in the same way as using the right of access - with the only difference that we will deliver/send the information to you in machine-readable form. Here we need at least 14 days
  • The right to erasure (to be forgotten) - Your other right is the right to erasure (to be forgotten). In this case, we will delete all your personal data from our systems and from the systems of all sub-processors, as well as from backups. We need 14 days to ensure the right to erasure.
  • In some cases, we are bound by a legal obligation, and e.g. we must register tax documents issued within the deadline set by law. In this case, we will delete all such personal data that are not bound by another law. We will inform you by e-mail about the completion of the deletion.
  • Complaint to the Office for Personal Data Protection - If you feel that we are not handling your data in accordance with the law, you have the right to contact the Office for Personal Data Protection with your complaint at any time. Please first inform us about this suspicion, so that we can do something to correct the possible error.
  • Unsubscribing from newsletters and business announcements - We send you e-mails with inspiration, articles, and product information/services if you are our customer based on our legitimate interest. If you are not yet a customer, we only send you e-mails based on your consent. In both cases, you can unsubscribe from our e-mails by clicking on the unsubscribe link in each email.

Confidentiality

We would like to assure you that our employees and associates who process your personal data are obliged to maintain confidentiality about personal data and security measures, the disclosure of which would risk the security of your personal data. This confidentiality also lasts after the end of contractual relations with us. Your personal data will not be released to any other third party without your consent.

The personal data processing policy is valid from 01/07/2022.
